This Agreement is entered into between McPars Sports Center (the “Management”) and the person making this reservation, together with all guests, players and minors in their party (collectively, the “Client”). By confirming a reservation, the Client accepts the following terms.
1. Assumption of Risk.
The Client acknowledges that pickleball, billiards and related recreational activities are physical in nature and carry inherent risks, including but not limited to slips, trips and falls; collisions with other players, equipment, nets, posts or fixtures; being struck by a ball, paddle or cue; muscular, skeletal or joint injury; heat-related illness; and aggravation of any pre-existing medical condition. The Client voluntarily assumes all such risks, whether known or unknown, and confirms that they and every member of their party are physically fit to participate.
2. Limitation of Liability.
To the fullest extent permitted by law, the Management, its owners, officers, employees and agents shall not be liable for any injury, illness, death, loss or damage sustained by the Client arising from the ordinary use of the courts, tables, equipment or premises, and shall not be responsible for any resulting medical, hospital, treatment, transport or related costs, which remain the sole responsibility of the Client. The Client is strongly encouraged to maintain their own health, accident or medical insurance.
Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under Philippine law, including liability arising from the Management’s own gross negligence, wilful misconduct, or fraud.
3. Personal Property.
The Client is responsible for their own belongings. The Management is not liable for the loss, theft or damage of any personal property brought onto the premises.
4. Damage to Venue Property — Client Liability.
The Client shall be fully liable to compensate the Management for any loss of or damage to venue property — including court surfaces, nets, posts, lighting, tables, cues, balls, rental paddles, fixtures, furnishings and the building itself — caused by the Client’s wilful act, negligence, misuse or failure to follow venue rules or posted instructions. Reasonable wear and tear from ordinary play is excepted. The Client agrees to pay the reasonable cost of repair or replacement, as assessed by the Management, upon demand.
5. Minors and Supervision.
A Client booking on behalf of a person under eighteen (18) years of age warrants that they are the parent or legal guardian, or are duly authorised by one, and accepts this Agreement on that minor’s behalf. Minors must be supervised at all times while on the premises.
6. Venue Rules and Right of Refusal.
The Client agrees to follow all venue rules, safety signage and the reasonable instructions of staff, to use appropriate non-marking footwear and sports attire, and not to attend while under the influence of alcohol or prohibited substances. The Management reserves the right to refuse entry or end a session, without refund, where conduct is unsafe, abusive or in breach of these rules.
7. Reservations, Payment and Cancellation.
A reservation is secured only upon confirmed payment. A booking marked for cash payment does not reserve the slot and may be released to another client who pays online first. Cancellation and rescheduling are subject to the venue’s published policy at the time of booking.
8. Severability and Governing Law.
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions continue in full force. This Agreement is governed by the laws of the Republic of the Philippines, with venue for any action in the courts of Cagayan de Oro City.
9. Acknowledgement.
By ticking the agreement box and confirming a reservation, the Client confirms they have read, understood and voluntarily accepted this Agreement on behalf of themselves and every member of their party, and that they do so freely and without inducement.
